Garnishments
A garnishment is the
process where a tax collecting agency attaches a taxpayer's net
wages currently owed or owed in the future by the taxpayer's
employer.
Can a
taxpayer stop a wage garnishment order?
Yes. If a garnishment
order results in no money available for the necessities such
as food and shelter for a taxpayer, the taxpayer could seek relief
from garnishment.
Can a
taxpayer negotiate and reduce the amount of a wage garnishment?
Yes. A taxpayer
could seek to reduce the amount of garnishment, provided that
the full amount of proposed garnishment would leave no funds
available to the taxpayer for the taxpayer's necessities.
Would
a bankruptcy proceeding stop a garnishment?
Yes. Any bankruptcy
proceeding will temporarily stop a wage garnishment.
Would
a "Homestead' filing on my home protect me against a garnishment?
No. A garnishment order
has no effect on your "Homestead.' While a creditor cannot
attach equity in your home that is subject to a "Homestead,'
a garnishment order is addressed to your employer who owes you
wages.
